Agreement to Terms
By accessing and using HeartBridge ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of these terms, you may not access the Service.
Description of Service
HeartBridge is an AI-powered nonprofit fundraising platform that provides:
- Online donation processing and management
- Campaign creation and management tools
- Event registration and ticketing
- AI-powered content generation using ChatGPT-4
- Email marketing and communication tools
- Analytics and reporting features
- Volunteer management systems
User Accounts
Account Creation
- You must provide accurate and complete information when creating an account
- You are responsible for maintaining the security of your account credentials
- You must notify us immediately of any unauthorized use of your account
- One account per organization; multiple users can be added as team members
Eligible Organizations
- Service is intended for legitimate nonprofit organizations
- Organizations must comply with applicable laws and regulations
- We reserve the right to verify nonprofit status
Acceptable Use
Permitted Uses
- Fundraising for legitimate charitable purposes
- Event management and registration
- Donor communication and engagement
- Volunteer coordination
Prohibited Uses
You may not use HeartBridge for:
- Illegal activities or fraudulent purposes
- Harassment, abuse, or harmful content
- Spam or unsolicited communications
- Violating intellectual property rights
- Personal fundraising or for-profit activities
- Political campaigns or lobbying activities
- Adult content or services
Payment Terms
Transaction Fees
- Standard rate: 2.9% + $0.30 per successful transaction
- No setup fees, monthly fees, or hidden charges
- Fees are automatically deducted from each transaction
- Refunded donations will have fees refunded as well
Payouts
- Funds are typically transferred within 2-3 business days
- You must provide valid banking information
- We may hold funds for security or compliance reasons
Content and Intellectual Property
Your Content
- You retain ownership of content you create and upload
- You grant us license to use your content to provide the Service
- You are responsible for ensuring you have rights to all content
- Content must comply with our community guidelines
AI-Generated Content
- AI-generated content is provided as-is for your use and modification
- You are responsible for reviewing and approving all content before publication
- We do not guarantee accuracy or appropriateness of AI-generated content
Our Intellectual Property
- HeartBridge platform, features, and branding are our property
- You may not copy, modify, or distribute our proprietary technology
- Our trademarks and logos may not be used without permission
Privacy and Data Protection
Your privacy is important to us. Our data practices are governed by our Privacy Policy, which is incorporated into these Terms by reference.
Data Security
- We implement industry-standard security measures
- You are responsible for protecting your account credentials
- Report any security concerns immediately
Service Availability
- We aim for high availability but do not guarantee uninterrupted service
- Scheduled maintenance will be announced in advance when possible
- We are not liable for service interruptions beyond our control
Termination
By You
- You may terminate your account at any time
- Contact support to request account closure
- Outstanding obligations survive termination
By Us
- We may suspend or terminate accounts for Terms violations
- We may terminate the Service with 30 days notice
- Immediate termination for illegal activities or fraud
Disclaimers and Limitations
Service Disclaimer
The Service is provided "as is" without warranties of any kind. We disclaim all warranties, express or implied, including merchantability and fitness for a particular purpose.
Limitation of Liability
To the maximum extent permitted by law, we shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the Service.
Indemnification
You agree to indemnify and hold us harmless from any claims, damages, or expenses arising from your use of the Service, violation of these Terms, or infringement of any rights.
Governing Law
These Terms are governed by the laws of the State of Illinois, without regard to conflict of law principles. Any disputes will be resolved in the state or federal courts located in Illinois.
Changes to Terms
We may modify these Terms at any time. We will notify users of significant changes via email or platform notification. Continued use after changes constitutes acceptance of the new Terms.
